What is the PMTA?
Everyone within the vaping community has at least heard about the PMTA, but most are unsure of what products could be affected. In May 2016, the FDA passed a deeming rule that stated vape manufacturers would adopt the application process that cigarette and smokeless tobacco manufacturers go through. The PMTA is a Premarket Tobacco Application where any vape juice created or altered after November 8th, 2016 (and all pre-filled pods and cartridges containing any flavors other than tobacco and menthol no matter when they are created) must have an application in by September 9th to continue producing the products.
The PMTA gives the FDA an opportunity to allow or deny a product based on; how it’s marketed, what's in it, the risk and benefits it must, the general public, if the product prevents use of a current tobacco product, if it may persuade a non-tobacco user to attempt it, and the procedures of the manufacturing.
What is Considered Tobacco? FDA's Deeming Rule
What is considered a tobacco product in this instance is covered by the FDA’s “Deeming Rule.” The Deeming Rule includes; cigarettes, cigarette tobacco, rolled tobacco, smokeless tobacco, including the components, parts, and accessories of these products. The FDA recently added to the deeming rule, which now includes the following products: ENDS (electronic nicotine delivery systems), e liquid, cigars, pipe tobacco, hookah and the accessories of these products.
99% of all vaping products will have to go through PTMA, including: all nicotine levels of all vape juices, including tobacco and unflavored, along with all vaping accessories that are distinctly designated for use in tobacco products. The products that are not covered by the PTMA are any accessories not plainly produced for use in tobacco products including; wire, cotton, batteries, and VG/PG.

The PTMA review process is time-consuming; and this application can take up to three years to complete.
How Does This Affect Vapors?
With the deadline rapidly approaching, you will start to notice significant changes within the vaping industry. Some fan favorite brands may have to stop manufacturing due to insufficient funds, or research. While some favorite brands may apply for the PMTA, the FDA can still deny some flavors, causing them to be discontinued. Another momentous part of the PMTA is the packaging of most companies is going to change as a part of the requirements.
Now, some of you may wonder which of your favorite vape juice/hardware brands are going forward and doing the PTMA, and as of right now we know of a few brands that have chosen to go this route. Below we will go into each brand that has announced they are going through with the PMTA’s so that you can keep as up-to-date as we are on what brands are starting/continuing the process.

As they haven’t said which products they have put the application in for, we are all holding our breath to see if our favorite SMOK products are going to make the cut.
